Tenancy Agreement

The legally binding agreement between Norbury Park Horticultural Society and each plot holder, covering rent, deposits, cultivation standards, inspections, breaches and termination.

This Allotment Tenancy Agreement ("the Agreement") is a legally binding contract between Norbury Park Horticultural Society ("the Society") and the individual named below ("the Tenant").

1. Parties and Plot

The signed paper agreement records the following details:

  • Tenant Name
  • Address
  • Email
  • Telephone
  • Plot Number
  • Plot Size (in rods)

2. Grant of Tenancy

2.1 The Society grants the Tenant a personal, revocable and non-transferable licence to occupy and cultivate the Plot.

2.2 This Agreement does not create a legal tenancy of land and does not give exclusive possession.

3. Tenant Obligations

The Tenant agrees to:

3.1 Comply with the Society's Rules, as amended from time to time.

3.2 Pay the annual rent on or before 1 November each year. A plot holder whose rent and subscription has not been paid by 31 October will be deemed to have relinquished their yearly agreement unless an extension of time has been granted by resolution of the Committee.

3.3 Keep the Plot under active cultivation and in a clean, tidy, and productive condition.

3.4 Control weeds, pests, and disease so as not to affect neighbouring plots.

3.5 Not cause nuisance, annoyance, or risk to other plot holders or the Society.

3.6 Use the Plot only for lawful purposes and in accordance with Society Rules.

3.7 Not assign, sublet, or share the Plot without prior written consent of the Committee.

3.8 Pay the required deposit of £100 (£50 for key deposit and £50 for plot) before taking possession.

3.9 Members intending to vacate plots at end of our year (30 September) must notify the Secretary by 1 September. No crops are to be taken off after 30 September.

4. Deposit

4.1 The deposit for the plot will be held by the Society for the duration of the Agreement.

4.2 The deposit will only be refunded after termination if:

  • The Plot is cleared of all personal belongings and waste;
  • The Plot is left in a satisfactory condition.

4.3 The Society will deduct from the deposit any reasonable costs for clearance, repairs or unpaid sums.

4.4 The key deposit will be refunded on return of the key in proper working condition.

5. Inspections

5.1 The Society may inspect the Plot at any reasonable time.

5.2 Routine inspections may be carried out without notice.

5.3 Where concerns are identified, the Society will notify the Tenant in writing.

6. Breach and Enforcement Process

6.1 If the Tenant breaches this Agreement or the Society's Rules, the Society may take the following steps:

Stage 1 - Informal Warning

  • A verbal or written reminder of the issue and required action.

Stage 2 - Written Notice

  • A formal notice setting out: the breach; the action required; and a reasonable deadline (normally 14-28 days).

Stage 3 - Final Notice

  • If the breach continues, a final written warning will be issued.

6.2 Failure to remedy the breach may result in termination under Clause 7.

6.3 Serious breaches including non-payment, abandonment or dangerous conduct, will result in immediate termination without following all stages above.

7. Termination

7.1 Either party may terminate this Agreement by giving at least 28 days' written notice.

7.2 The Society may terminate immediately where the Tenant:

  • Fails to pay rent within a reasonable time;
  • Abandons the plot;
  • Commits a serious or persistent breach as decided by the Committee;
  • Fails to maintain the Plot after notice has been given.

7.3 On termination, the Tenant must:

  • Stop using the Plot;
  • Remove all personal property and waste;
  • Return the Plot in a satisfactory condition.

7.4 Any items left on the Plot after termination may be removed and disposed of by the Society, and costs may be recovered from the Tenant.

8. Plot Changes and Records

8.1 A new Agreement must be signed if the Tenant moves to another plot.

8.2 Only one Agreement shall exist per plot at any time.

8.3 The Society will securely retain all Agreements and related records.

9. Liability and Risk

9.1 The Tenant uses the Plot at their own risk.

9.2 The Society is not responsible for loss, theft, or damage to property unless caused by its negligence.

10. General

10.1 This Agreement is personal to the Tenant and cannot be transferred.

10.2 Any variation must be made in writing by the Society.

10.3 If any part of this Agreement is found invalid, the remainder will still apply.

10.4 This Agreement is governed by the laws of England and Wales.

11. Signatures

By signing below, both parties confirm that they have read, understood, and agree to this Agreement.

The paper agreement is signed and dated by the Tenant, and signed on behalf of Norbury Park Horticultural Society by a named committee member with their position recorded.
